What the GPSR Means for Your Business

The General Product Safety Regulation (EU) 2023/988 applies to consumer products placed on the EU market from 13 December 2024. It replaced the previous General Product Safety Directive and significantly raised the bar - particularly for online sellers.

Under the GPSR, most consumer products may only be sold into the EU if there is a responsible economic operator established in the EU - a manufacturer, importer, authorised representative or fulfilment provider - whose name and contact details appear with the product. Products must be safe, supported by an internal risk analysis and technical documentation, and traceable. Online listings must display the responsible operator's details and relevant safety information.

For UK and other non-EU businesses, this is the change that blocked marketplace listings overnight: without an EU responsible person named on the listing, Amazon and other platforms will not let the product be sold to EU customers.

Does the GPSR apply to my products?

If you sell consumer products into the EU - directly or via online marketplaces - the GPSR almost certainly applies. It covers most non-food consumer products that aren't governed by stricter sector-specific legislation, and it applies to products offered for sale online to EU consumers.

I'm a UK seller. Do I need an EU representative under GPSR?

If there is no other EU-established economic operator in your supply chain (such as an EU importer), yes - you need an EU authorised representative before your products can be legally offered to EU consumers. Post-Brexit, a UK establishment does not count.

What must my online listings show under GPSR?

Listings must identify the manufacturer and the EU responsible economic operator with contact details, identify the product, and include any warnings or safety information relevant to the product.

What documentation does GPSR require?

An internal risk analysis and technical documentation appropriate to the product, kept for ten years and available to authorities. Traceability information must also be maintained.
